Hive Digital Technologies Challenges Swedish Government Over Cryptocurrency Mining VAT Charges
Hive Digital Technologies is embroiled in a contentious dispute with the Swedish government over Value-Added Tax (VAT) charges related to its cryptocurrency mining operations.
The issue arises from the Swedish Tax Agency's reclassification of Hive's datacenter services as self-mining, which has resulted in the retroactive denial of input VAT recovery for its subsidiaries Bikupa Datacenter AB and Bikupa Datacenter 2 AB.
Hive argues that it provides taxable compute power services to identified customers under contract, an activity similar to a data center hosting agreement. The company claims that this classification has a substantial financial effect on its business, as hardware, cooling, and electricity costs are major expenses for the operation.
Hive is seeking to elevate this complaint to the European Commission, as Swedish courts have refused to refer this question to the Court of Justice of the European Union (CJEU). The issue could set a precedent for similar disputes in the region if the European Commission chooses to investigate further and take action.
