House Committee Considers Crypto Tax Breaks with $10 Fee Exemption

The House Ways and Means Committee is set to consider legislation on Wednesday that would introduce tax breaks for certain crypto transactions, including a 'de minimis' exemption for fees of $10 or less.

The Digital Asset Tax Certainty Act, introduced by Chairman Jason Smith, R-Mo., aims to clarify federal tax rules for stablecoins, staking, mining, and digital asset trading.

Paying blockchain fees with crypto can create a taxable event due to the IRS treating digital assets as property. The proposed exemption would allow taxpayers to disregard gains or losses on eligible fees.

The bill also proposes using the redemption value of qualifying dollar-pegged stablecoins as their tax basis, taxing mining and staking rewards as ordinary income, and allowing certain investment trusts to stake assets without jeopardizing their tax status.
