ICBA Challenges OCC's Crypto Trust Charter Authority
The Independent Community Bankers of America (ICBA) has filed a lawsuit against the Office of the Comptroller of the Currency (OCC) over its authority to grant national trust bank charters to crypto firms. The lawsuit, filed on October 2 in the U.S. District Court for the District of Columbia, argues that the OCC has exceeded its authority under the National Bank Act.
The ICBA claims that crypto firms holding trust charters do not face the same capital and liquidity standards, consolidated supervision, or Federal Deposit Insurance Corp. (FDIC) coverage as insured banks. The group argues that this framework allows crypto firms to gain banking status without meeting the same requirements as traditional banks.
The lawsuit is a challenge to the OCC's authority to grant national trust bank charters to crypto firms, and it remains to be seen how the courts will rule on the matter.
