The Securities and Exchange Commission (SEC) continues to hold firm on its position that most tokens are securities, requiring issuers to register or face enforcement action. The Commodity Futures Trading Commission (CFTC) is asserting broader jurisdiction over assets classified as commodities, including Bitcoin and potentially Ether. Meanwhile, the Federal Reserve has set out its position on stablecoins and banks with exposure to digital assets.
The industry is responding by shifting its strategy from lobbying lawmakers to direct engagement with regulators. This pragmatism comes with risks, but for institutional players seeking regulatory clarity, it may be a necessary step forward.
