Ripple: CLARITY Act Setback Does Not Change XRP’s Legal Status
Ripple has stated that the failed CLARITY Act vote did not change XRP's established legal position in the US.
The bill, which aimed to clarify the regulatory treatment of digital assets, was voted down by the Senate on September 15 with a 49-50 margin.
Ripple Chief Legal Officer Stuart Alderoty pointed out that two key developments predate the Senate vote: a 2023 federal court ruling and a March 2026 joint interpretation from the SEC and CFTC.
The court found that Ripple's programmatic sales of XRP on exchanges did not constitute securities transactions, although certain institutional sales did. The joint interpretation listed XRP among 16 digital assets classified as digital commodities.
