Ripple's Regulatory Advantage Remains Intact Amid Senate Setback
XRP plummeted by more than 8% following the Senate's rejection of the Digital Asset Market Clarity Act, which would have provided a federal market-structure framework for cryptocurrencies.
The vote, which ended in a 49-50 tie, effectively stalls the bill and removes a near-term route toward putting a regulatory framework into statute. Despite this setback, Ripple's Chief Executive Brad Garlinghouse stated that the result 'stings' but does not alter the company's commercial trajectory.
Ripple's confidence rests partly on the regulatory ground XRP gained before the CLARITY vote, which remains intact despite the Senate setback. The SEC and CFTC issued a joint interpretation in March outlining how federal securities laws apply to several categories of crypto assets, including XRP. This treatment preserves regulatory clarity for XRP.
Ripple's existing US regulatory treatment is less durable than legislation, leaving the company dependent on future rulemaking or court decisions to solidify its position. The company plans to continue expanding its global business while pressing for clearer U.S. rules.
