SEC Ditches Crypto Cases Amid Rulemaking U-Turn
Former acting SEC Chair Mark Uyeda explained why the agency dropped civil cases against several cryptocurrency companies, including Kraken, Ripple Labs, and Coinbase, in early 2025. The decision was due to a planned '180-degree change' in rulemaking, according to Uyeda.
The agency faced concerns about defending prior legal interpretations while preparing new policies, which could have undermined the SEC's credibility. Uyeda stated that he did not want litigators arguing one commission interpretation in court while the SEC was preparing to issue another, citing the potential damage to the agency's reputation.
The leadership transition at the SEC has significant implications for the crypto sector, with only two of five leadership seats filled after Commissioner Hester Peirce is expected to leave in November. The reduced capacity for rulemaking and enforcement priorities may impact the agency's ability to push through broader changes in regulation.
