SEC Drops Crypto Cases Over Credibility Concerns
SEC Commissioner Mark Uyeda revealed that the agency has withdrawn several civil enforcement actions targeting cryptocurrency companies. The decision was made due to concerns over the SEC's credibility if they continued pursuing cases under a previous administration's framework, only to abandon those positions through a '180-degree change' in rulemaking.
The withdrawn cases included matters involving Kraken, Ripple Labs, Coinbase, and others. Uyeda emphasized that there were significant concerns about whether these cases were truly defensible under law, given the expected changes in the agency's approach.
Uyeda noted that the SEC could not justify asking its legal team to stand in court on arguments authorized under the prior administration while simultaneously issuing a fundamentally different interpretation. He linked this decision directly to institutional credibility and argued that the commission's effectiveness depends on consistency between litigation positions and the SEC's evolving stance.
The leadership structure at the SEC is expected to change again, with Commissioner Hester Peirce's departure in November leaving only two of the five members on the leadership panel. This shift could further shape how crypto-related enforcement risk is assessed over the coming months.
