SEC Drops Crypto Cases Over Credibility Concerns Amid Rulemaking Shift
SEC Commissioner Mark Uyeda revealed that several crypto-related companies had their civil enforcement actions dropped due to concerns about credibility. The dismissals were tied to a shift in how the agency approaches rulemaking and litigation strategy, according to Uyeda.
The former SEC Acting Chair, who served from January to April 2025, argued that continuing cases authorized under earlier leadership could undermine the SEC's credibility if the agency's legal posture changes. He explained that this could lead to an '180-degree change' in positions becoming inconsistent in court.
Uyeda linked the dismissals to preparations for a major shift in SEC rulemaking and litigation approach, stating that there were doubts about whether the earlier cases were 'justifiable under law.' The commissioner suggested that the agency was concerned about appearing internally inconsistent, which could harm its credibility.
