SEC Ignites Cryptocurrency Regulations Amid Congressional Gridlock
The Securities and Exchange Commission (SEC) has taken proactive steps to move forward on crypto regulations despite the delay in Congress. SEC Chair Paul Atkins scheduled an open meeting for August 14 to consider a tailored offering rule for certain crypto investment contracts, which would carve out a lighter path for token offerings that face full securities registration.
This is part of Atkins' Project Crypto initiative, announced last November, which produced a Regulation Crypto package covering token registration exemptions and broker-dealer custody rules. The SEC is also preparing an 'innovation exemption' that would allow tokenized versions of listed stocks to trade on blockchains 24/7 with near-instant settlement.
The carve-out for tokens would track economic exposure to shares, not carry voting or dividend rights. SEC Commissioner Hester Peirce cautioned that the exemption may be less monumental than expected, and community bankers fear stablecoin yield pulling deposits out of local branches.
