SEC May Take Lead in Crypto Regulation Despite Stalled Legislation
Bitwise Chief Investment Officer Matt Hougan is optimistic about the future of the cryptocurrency industry despite the uncertainty surrounding the CLARITY Act. The proposed bill, aimed at providing a regulatory framework for digital assets, has stalled in Congress and may not pass before its August recess. However, Hougan believes that even without legislative action, the U.S. Securities and Exchange Commission (SEC) may introduce rules that are favorable to the crypto industry.
Hougan pointed out that the SEC can issue regulations and guidance under existing securities laws, which could define digital asset classifications more clearly than the CLARITY Act. This view aligns with recent SEC actions, such as approving certain spot Bitcoin ETFs and engaging in dialogue with industry stakeholders, which signal a more pragmatic approach under Chair Gary Gensler's tenure.
The potential for SEC-driven clarity could reduce regulatory uncertainty, which has long been a drag on institutional adoption. If the SEC introduces rules that define digital asset classifications more clearly, it could pave the way for broader market participation and new financial products.
