SEC Prepares Alternative Path if Clarity Act Fails
The SEC is prepared to create its own rules for the crypto market if Congress fails to pass the Clarity Act, according to Chairman Paul Atkins. The agency has been working on a Regulation Crypto rulemaking package as part of its 2026 agenda, which covers token registration exemptions and decentralizing projects. However, this route has limitations, as administrative actions can be withdrawn by a future administration without Congressional approval.
The Clarity Act has already cleared the House and Senate Banking Committee, but it remains unclear whether it will pass the full Senate before the August recess. Senate Democrats have raised concerns about the bill's ethics provisions, which they believe do not go far enough in regulating officials' crypto dealings.
Atkins emphasized the importance of a statute to provide future-proofing for the framework and expressed optimism that Congress will pass the bill. He also highlighted the need for certainty, stating that 'statute is the way to future-proof something.'
