SEC Unveils New Crypto Rules Allowing Up to $75 Million in Unregistered Fundraising
The US Securities and Exchange Commission (SEC) has proposed new rules for crypto assets, allowing issuers to raise up to $75 million in any 12 months without registering as securities. This is a significant relaxation of regulations, which currently cap fundraising at $5 million over four years.
The SEC's proposal also sets out a safe harbour under which a token can stop being treated as part of an investment contract once the managerial efforts promised to investors are completed or permanently abandoned.
This move is seen as a major step towards modernizing federal securities regulations for crypto assets, with SEC Chairman Paul Atkins stating that it will 'ensure that we lead' in crypto regulation.
