SEC's Crypto Rulemaking Hits Roadblock as Peirce Exits Ahead of Comment Period
Commissioner Hester Peirce is leaving the Securities and Exchange Commission (SEC) on October 3, just 18 days before the comment period for the Regulation Crypto Assets Notice of Proposed Rulemaking (NPRM) closes. The NPRM proposes two exemptions for digital assets: a $5 million startup window and a $75 million ongoing exemption modeled on Regulation A.
The SEC's crypto rulemaking is now facing its first real stress test, as Peirce was the architect of the Reg Crypto Assets NPRM and her departure has left no named successor for the Task Force leadership. The commission is down to two members: Chairman Paul Atkins and Commissioner Mark Uyeda, who must agree on every comma when synthesizing 150-plus requests for comment.
The SEC's regulatory path is already narrowing, with the CLARITY Act failing its Senate cloture vote on September 15. If the two-person commission cannot find common ground on a final rule, the framework risks stalling indefinitely.
