Senate Delay Threatens Crypto Market Growth with Clarity Act at Risk
The passage of the Digital Asset Market Clarity Act (CLARITY Act) is facing uncertainty in the US Senate, potentially impacting the crypto market. According to JPMorgan analyst Nikolaos Panigirtzoglou, declining odds of the bill becoming law by year-end pose a headwind for the entire crypto market.
The CLARITY Act aims to split oversight of digital assets between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC), reducing compliance burdens that have driven issuance and trading activity offshore. If passed, tokens classified as digital commodities would fall under CFTC supervision, while new projects could raise up to $75M annually without full SEC registration.
JPMorgan notes that delays in Senate action may lead to tokenization and blockchain applications being absorbed by traditional market infrastructures instead of benefiting public crypto networks. With the Senate shelving the bill ahead of the August 8 recess, institutional support is still present, but legislative hurdles remain, including the need for 60 votes.
