Senate Vote Tomorrow Will Decide US Crypto Regulation for Next Decade
A crucial Senate vote is scheduled for tomorrow at 2:15 PM ET to determine whether America will finally have a clear regulatory framework for digital assets. The Digital Asset Market Clarity Act (H.R. 3633) has been making its way through the legislative process, and if passed, it would give digital commodities a defined regulatory home under the CFTC.
Currently, the line between what falls under SEC jurisdiction versus CFTC jurisdiction is unsettled, decided case by case through enforcement actions and shifting agency interpretations. The Clarity Act would fix this by defining digital commodities as a distinct category that would cover most decentralized tokens and DeFi-native assets, while traditional securities stay under the SEC.
Senator Cynthia Lummis framed the choice facing her colleagues in stark terms ahead of the vote, saying they face a decision between American leadership, real consumer protections, and giving law enforcement the tools they need to address illicit finance, or driving the digital asset industry overseas. She warned that if cloture fails, it will push any real legislative framework out toward the next decade.
The bill's passage is crucial for DeFi protocols and digital asset exchanges, which would finally get a defined framework to build against. This clarity would be a prerequisite for institutional capital that has been waiting on the sidelines for exactly this kind of clarity.
