South Africa Tackles Cryptocurrency Regulation
The National Treasury and South African Reserve Bank have released draft regulations for cross-border cryptocurrency transactions. This move aims to bring crypto assets under the country's framework for managing money movement across its borders.
The current Exchange Control Regulations of 1961 do not cover cryptocurrencies, but a High Court ruling in 2025 found that they did not fall under the existing definition of capital requiring approval for cross-border transactions.
Finance Minister Enoch Godongwana emphasized the need for a regulatory framework that can keep pace with cryptocurrency usage. The draft regulations published on April 17, 2026, aim to address this gap.
Crypto assets are now explicitly part of South Africa's capital flow management system. Cross-border crypto transactions will be subject to oversight similar to traditional financial instruments and foreign currency movements.
