South Africa's Reserve Bank Draft Exchanges Control Framework for Crypto Transactions
The Reserve Bank of South Africa's draft Crypto Asset Manual has sparked controversy over its proposed exchange-control framework for crypto transactions. MoneyBadger CEO Carel van Wyk argues that private wallets should not trigger cross-border flow requirements, claiming they do not indicate funds are held outside the country.
Van Wyk points out that many South Africans already use Bitcoin to pay for everyday goods and services through self-custodial wallets, with payment providers converting the cryptocurrency into rand for local merchants. He argues that this should be treated as a domestic transaction, not subject to exchange-control restrictions or routine reporting to the Financial Surveillance Department.
The draft rules distinguish between crypto transactions resulting in cross-border inflows or outflows and those used for domestic payment purposes. The Reserve Bank has yet to finalize its framework, leaving the regulatory treatment of domestic Bitcoin payments from self-custodial wallets subject to further clarification.
