U.S. Crypto Regulatory Developments Move Forward Despite Clarity Act Setback
The Clarity Act, aimed at establishing a comprehensive federal framework for digital asset markets in the United States, suffered a setback on September 15 after failing to advance due to a lack of votes. Despite this, regulatory developments are continuing.
The Securities and Exchange Commission (SEC) has proposed Regulation Crypto Assets, which would provide a framework for certain investment contracts involving digital assets to raise capital under U.S. securities laws. The proposal includes exemptions for offerings up to $5 million over four years or $75 million in 12 months, with issuers still subject to disclosure requirements and anti-fraud rules.
The Commodity Futures Trading Commission (CFTC) is also moving forward, authorizing the listing of bitcoin perpetual contracts on exchanges registered with the agency. This development aims to provide greater oversight and transparency for these products.
