UAE Cracks Down on Crypto Regulations: VARA and SCA Tighten Grip

The United Arab Emirates (UAE) is strengthening its position as a hub for digital innovation and blockchain technology by refining its regulatory framework. The UAE lacks a single authority on crypto regulations, with different jurisdictions having their own governing bodies.

In the mainland UAE, the Securities and Commodities Authority (SCA) regulates cryptocurrency assets, while Dubai has created the Virtual Assets Regulatory Authority (VARA) to oversee virtual asset activity in the Emirate. Abu Dhabi Global Market (ADGM) also regulates digital assets through its Financial Services Regulatory Authority (FSRA), and the Dubai International Financial Centre (DIFC) regulates some activities of digital assets under its financial services regime.

The VARA regulation UAE, introduced by Dubai Law No. 4 of 2022, has brought about significant changes in the virtual asset landscape. A general licensing regime was established for virtual asset exchanges, broker-dealers, custody providers, advisory services, banking and finance systems, and virtual asset management and investment solutions.

The VARA regulation UAE emphasizes consumer protection, with stricter marketing and promotion regulations, mandatory reporting of compliance, and effective separation of customer funds. The mainland UAE's SCA framework also requires cryptocurrency asset service provider licensing, minimum capital requirements, strong Anti-Money Laundering (AML) and Counter-Terrorism Financing (CTF) procedures, cybersecurity systems, and risk management.
