UK Crypto Regs: Credibility Trumps Regulation

Share

The UK's new crypto regulations aim to establish credibility and attract responsible firms, but experts warn that this may not be enough to address emerging risks.

The Financial Conduct Authority (FCA) has published its cryptoassets regime policy statements, marking a significant milestone in the UK's regulation of the virtual asset industry. The package covers admissions and disclosures, market abuse, stablecoin issuance, custody, trading platforms, intermediaries, staking, prudential requirements, operational resilience, and more.

However, as the FCA itself acknowledges, building credibility is a harder task than it seems. Crypto has evolved beyond its speculative roots, with emerging technologies like decentralized finance (DeFi) and stablecoins increasingly interacting with traditional financial systems. This presents co-mingled risks that could accelerate and amplify existing vulnerabilities.

The UK must navigate this complex landscape to maintain its position as a leading centre for financial innovation. A regulatory regime that fails to address the less visible infrastructure through which illicit finance moves will be open to exploitation by criminal actors. Conversely, a regime with high burdens but lacking clarity, predictability, and credibility will struggle to attract responsible firms.

To succeed, the UK must strike a balance between regulating today's visible crypto market and addressing emerging risks. This will require ongoing collaboration among regulators, industry experts, and financial institutions to ensure that regulations keep pace with technological advancements.
