UK Draws Perimeter for Offshore Crypto Platforms Ahead of 2027 Rules
The UK's Financial Conduct Authority (FCA) has outlined the boundaries for offshore cryptocurrency platforms ahead of new rules set to take effect in October 2027. According to the FCA, overseas providers can enter the UK perimeter when they serve British consumers, even if their business is established abroad.
The regulator's guidance explains that a 'UK consumer' refers to an individual in the UK acting outside of a trade, business, or profession. This definition differs from client categories elsewhere in the FCA Handbook.
For overseas crypto providers, the key factor determining whether they fall inside the UK perimeter is consumer access and agency trading. When authorized firms trade as agents for UK consumers, offshore platforms can enter the scope of the new rules.
The guidance also highlights separate tests for custody and staking providers, who must demonstrate that they act independently or are directed by an authorized firm to fall within the perimeter.
