US Crypto Regulation Takes a Sharp Turn After CLARITY Vote Fails

The US crypto regulation landscape has been thrown into uncertainty after a narrow vote in the Senate failed to pass the Digital Asset Market Clarity Act, also known as CLARITY. On September 15, the bill fell one short of invoking cloture with a tally of 49-50.

Senator Coons was absent from the vote, while Senators Collins, Hawley, Moran, and Tillis voted against it, with Senator Tillis specifically reserving his right to file a motion to reconsider. The outcome was far from unexpected, given the opposition tied to the administration itself.

SEC Chairman Paul Atkins and CFTC Chairman Michael Selig have since weighed in on the situation. In a statement, Atkins expressed gratitude for those who worked on the bill across the administration, Congress, investors, and innovators, emphasizing that his agency would act decisively within its existing statutory authority to deliver certainty for American investors and entrepreneurs, with or without legislation.

CFTC Chairman Selig echoed a similar posture, calling the Senate outcome unfortunate while insisting Americans still deserve regulatory clarity, legal certainty, and consumer protections in crypto markets. He added that the CFTC is 'locked in and ready to ship its rules for the new frontier of finance.'
