US Senator Seeks to Clarify Crypto Tax Laws with Stablecoin Exemption Bill
A bipartisan effort to modernize US tax laws for cryptocurrency has gained momentum as Senator Steve Daines introduced the ADAPT Act, a comprehensive bill that would exempt stablecoin payments from capital gains tax recognition. The proposal, which was submitted on September 30, aims to bring clarity to the current tax framework and align digital assets with traditional financial principles.
The key provision of the bill is the exemption for regulated US dollar-backed stablecoins in everyday transactions, allowing taxpayers to avoid calculating taxable gains or losses when using these coins for purchases. This relief would also extend to third-party broker reporting requirements for qualifying consumers, although professional traders and registered broker-dealers are excluded from this tax break.
The ADAPT Act also introduces wash sale rules to digital assets, mirroring the regulations governing equity markets. Additionally, it establishes tax guidelines for onchain activities such as staking, mining, and transaction fee payments. Under the proposal, transactions with network or gas fees of $10 or less would be exempt from realizing capital gains or losses, excluding high-volume users, wholesale operators, and financial intermediaries.
