The regulatory landscape for XRP has shifted from debating its legitimacy to designing the infrastructure for its integration into traditional finance. According to ETF analyst Nate Geraci, policymakers are now focused on the architecture of crypto integration rather than its acceptance.

This shift is particularly significant for XRP, which has a more developed legal history in the US due to a high-profile court battle that concluded in August 2025. The case left intact the final judgment from District Judge Analisa Torres, who determined that Ripple's programmatic sales of XRP did not constitute unregistered securities offerings.

However, certain institutional sales fell within the scope of existing securities law, leaving XRP's regulatory status tied to specific transaction circumstances rather than a blanket determination. The CLARITY Act, which is approaching a critical Senate procedural vote on September 15, aims to constrain the SEC's authority where a non-appealable US court judgment issued before the law's enactment determined that a digital asset was not a security.

Meanwhile, the SEC is moving forward with its own modernization efforts, proposing an update to transfer-agent rules that explicitly recognizes blockchain technology in securities offerings and share transfers. This development aligns with Ripple's expanding push into tokenization, custody, stablecoins, and institutional financial infrastructure.
