The debate over XRP's regulatory status may be focusing on the wrong question. According to crypto commentator X Finance Bull, the token has already established a solid foundation in US law through court rulings and agency classifications. This foundation dates back to Judge Analisa Torres' 2023 decision in the SEC vs Ripple case, which established that XRP is distinct from investment contracts tied to certain Ripple sales.
The district court's findings were left intact after both parties chose not to pursue appeals in August 2025. A second layer of regulatory clarity came on March 17, 2026, when the SEC and CFTC jointly introduced a formal crypto taxonomy that explicitly named XRP as a digital commodity.
