Amazon Driver and Employer Sued After Four-Year-Old Boy Struck and Killed
The parents of four-year-old Tadens Joseph have filed a wrongful death lawsuit against Amazon delivery driver Estefany Lara Ortiz and her employers after their child was struck and killed by an Amazon van in May.
On the evening of May 4, Tadens was playing in a park on East Third Terrance in Kansas City, Missouri when he entered the roadway and was hit by the Amazon delivery van. The driver initially stopped but left the scene before police arrived, only to be taken into custody later.
The lawsuit claims negligence and vicarious liability against Ortiz, Daval Express LLC, and principal David Nelson Maasen. It alleges that children were plainly visible in the area when Ortiz parked to make a delivery and that she should have seen Tadens before putting the vehicle in motion.
