American Express Sued Over Alleged Credit Reporting Misconduct
A lawsuit has been filed against American Express National Bank for allegedly reporting settled debts as unpaid to credit bureaus. The plaintiff, Brendan Pohl, claims he reached a settlement agreement with the bank in May 2023 and made full payments on two business accounts. However, despite confirming receipt of the payments, the bank continued to report the accounts as charged-off debts.
Pohl alleges that American Express submitted inaccurate information to TransUnion, Experian, and Equifax every 30 days, causing significant damage to his credit score over time. He is seeking actual, statutory, and punitive damages for alleged violations of the Fair Credit Reporting Act, the California Consumer Credit Reporting Agencies Act, and the Rosenthal Fair Debt Collection Practices Act.
