Cisco Lawyer's Resignation Sparks Debate Over Constructive Dismissal
A senior lawyer at Cisco Systems Australia claimed he was forced out of his job after suffering from Long COVID and other health issues. However, the Fair Work Commission disagreed, finding that he resigned by choice in March 2025.
The man worked for Cisco from 2015 until his resignation, during which time he argued that the company breached his contract, leading to constructive dismissal. The Commission examined WhatsApp messages between the lawyer and his manager, which were initially quoted selectively by the lawyer. However, when the full exchanges were reviewed, the Commission found that the manager's messages showed support and concern for the lawyer's well-being.
The Commission did criticize Cisco for its handling of two financial matters: a bonus payment that was not made, and a salary reduction to the maximum payable under New South Wales workers' compensation rules. While the company had the right to make these changes, the Commission found the process to be 'clumsy', but not motivated by a desire to force the lawyer out.
