Consumers Sue Anthropic, OpenAI, SpaceXAI, and Google Over Alleged AI Pact
Four consumers have filed a class-action lawsuit against Anthropic, OpenAI, SpaceXAI, and Google in federal court, accusing them of colluding to slow down the pace of their competing frontier AI products.
The complaint alleges that representatives from these companies formed a working group in July 2026 to create an industry standards body, and by September 2026, they had publicly proposed slowing down AI development. Anthropic CEO Dario Amodei wrote an essay on September 12, 2026, stating 'We must slow the pace at which we improve the capabilities of AI models.'
The plaintiffs claim that this agreement is a violation of federal antitrust law and seek treble damages under the Clayton Act. They also request an injunction to bar each defendant from entering into any horizontal agreements concerning the rate at which competing AI products are developed or improved.
The market for paid consumer subscriptions to general-purpose frontier generative-AI assistants is allegedly dominated by the four defendants, with OpenAI's ChatGPT Plus tier priced at approximately $20 per month. The plaintiffs argue that an agreement slowing improvement lowers the quality subscribers receive for the price they pay, which is an overcharge of the kind antitrust law was enacted to prevent.
The proposed nationwide class covers all persons in the United States who purchased a paid individual consumer subscription to one of the four services directly from a defendant since September 12, 2026.
