Court Blocks Merck Challenge to Medicare Drug Pricing Framework

A federal court has denied Merck & Co., Inc.'s (NYSE:MRK) challenge to the Medicare Drug Price Negotiation Program, upholding a key provision of the Inflation Reduction Act.

The program allows the government to negotiate prices for certain high-expenditure drugs with no generic competitors. Federal administrators seek the lowest maximum fair price for each chosen drug, capping negotiations at 75% of private market value.

Pharmaceutical companies that decline participation or fail to reach pricing agreements face severe daily excise taxes on all product sales, including non-Medicare transactions. Penalties start at 185.71% of the drug's sales price and escalate up to 1,900% after 270 days.
