Google Appeals Court Ruling on Liability for AI-Generated False Claims

Google has announced plans to appeal a court ruling that found the company liable for false claims appearing in its AI-based search platform, AI Overviews. In May, the Regional Court of Munich ruled that Google is responsible for defamatory content generated by AI Overviews because it produces 'independent, new, and substantive statements' that are considered Google's content.

The case began when two publishing companies, part of a Munich-based media group, claimed that AI Overviews made false claims about them. The companies alleged that the platform stated they were known for disreputable business practices and operating a fraud scheme.

Google argues that AI Overviews is designed to show information that reflects what appears as written text across the web about a specific topic, and serves up links to websites that back up what has been presented. The company claims that it invests heavily in the quality of AI Overviews, but acknowledges that there can be cases where AI Overviews miss context or misinterpret web content.

The ruling could have implications for other artificial intelligence platforms and developers, as it sets a precedent for direct legal responsibility for defamatory content generated by AI systems.
