Google Loses Bid to Dismiss $1.5 Billion Ad Tech Lawsuit
A New York judge has ruled that most of Google's motion to dismiss a $1.5 billion ad tech lawsuit brought by Gannett and the Daily Mail cannot be granted, allowing the case to go to trial.
The suit claims that Google's secret auction programs, including Project Bernanke and Enhanced Dynamic Allocation, cost the publishers around $600 million and $900 million respectively.
A class of websites that sold ads through Google's AdX exchange is also seeking damages of $1.72 billion, according to economist Einer Elhauge.
The judge has rejected most of Google's arguments, including its claims that the programs did not harm competition in the ad server or ad exchange markets.
