IBM Wins Dismissal of Xinuos Software Copyright Lawsuit

IBM has prevailed in its bid to dismiss a software copyright lawsuit filed by Xinuos Inc., with the US Court of Appeals for the Second Circuit ruling that the company's claims were time-barred.

The court found that Xinuos' dispute over a decades-old joint-development agreement was not analogous to either copyright infringement or ownership claims, and therefore the lower court correctly held that the lawsuit was filed too late.

Xinuos had argued that its predecessor's software copyright allegations against IBM were still valid, but the appeals court disagreed, stating that the dispute was more akin to a joint-development agreement than a traditional copyright claim.
