Michigan Climate Suit Against Oil Companies Dropped

A federal judge has dismissed a lawsuit filed by Michigan Attorney General Dana Nessel against oil and gas companies, including BP PLC, Chevron Corp., Exxon Mobil Corp., Shell PLC, and the American Petroleum Institute.

The suit alleged that these companies contributed to climate change and engaged in an unlawful conspiracy to stifle competition from renewable energy. However, U.S. District Judge Jane M. Beckering ruled that Michigan lacks antitrust standing to pursue an injunction or recover damages.

In her decision, Beckering noted that the claimed injury between the alleged conspiracy and overcharges for Michigan residents is 'too great.' She also pointed out that the lawsuit relied on a 'chain of causation' with 'vaguely defined links,' making it difficult to establish a direct link between the companies' actions and the alleged harm.

The judge further stated that the antitrust laws do not protect against all the injuries for which Michigan seeks a remedy. She noted that the company's success in entrenching supracompetitive fossil fuel prices depends on multiple market forces beyond their control, including technological developments, other investors, and public interest in renewable energy.
