Microsoft Wins Partial Dismissal in ChatGPT Antitrust Case
A US federal judge has granted partial dismissal to Microsoft in an antitrust case brought by ChatGPT subscribers, dismissing one of their key claims while allowing them a chance to amend others. The dispute centers on allegations that Microsoft's commercial relationship with OpenAI restricted the AI company's access to computing infrastructure and imposed a price floor on ChatGPT products.
US District Judge P. Casey Pitts in California ruled that the subscribers had not demonstrated sufficient injury to sustain their antitrust claim, as they are consumers of generative-AI services rather than rival cloud-computing suppliers allegedly affected by Microsoft's actions.
The decision leaves parts of the litigation in federal court after Microsoft attempted to send the dispute to arbitration. The case is ongoing, with the plaintiffs given an opportunity to amend their allegations.
