Starbucks Wins Appeal Over Dress Code Policy

A US appeals court has ruled that Starbucks' dress code for employees at its flagship Manhattan store did not violate labor laws. The 2nd US Circuit Court of Appeals overturned a decision by the National Labor Relations Board (NLRB) that said the company's policy was too restrictive and interfered with workers' rights to unionize.

The NLRB had previously ruled that Starbucks broke the law by prohibiting employees from wearing t-shirts or multiple pins supporting a union. However, the appeals court argued that the NLRB failed to properly balance the company's need to present its preferred image to customers with its workers' rights to advocate for better working conditions and join unions.

The ruling is the latest in a series of decisions by US appeals courts that have sided with employers on workplace dress code issues. In 2023, a court ruled that Tesla could bar factory workers from wearing union t-shirts, and last year, a St. Louis-based court said Home Depot had the right to bar employees from writing 'Black Lives Matter' on their orange work aprons.

The Starbucks store in question is a large, upscale location with an on-site roastery and coffee bars. Employees at this store wear brown aprons and collared shirts or turtlenecks in muted colors, and are allowed to opt for pre-approved shirts and pins that support various causes.
