Whole Foods Wins NLRB Case Over BLM Display Ban

The National Labor Relations Board (NLRB) has ruled in favor of Whole Foods Market Inc. in its case over banning workers from wearing 'Black Lives Matter' messaging on their clothes or accessories.

The NLRB held that the workers' display did not have a goal related to their job terms or employment status, and therefore was not protected by federal labor law.

This decision comes after the board distinguished the Whole Foods case from its earlier ruling in Home Depot, which faulted the retailer for effectively firing a worker for refusing to remove a BLM insignia off their work apron. The US Court of Appeals for the Eight Circuit had previously vacated that decision.
