Supreme Court Set to Decide on Prediction Market Regulatory Authority

New Jersey's Attorney General Jennifer Davenport has asked the Supreme Court to decide whether states have authority over prediction markets, sparking a major legal clash in the industry.

Prediction markets like Kalshi and Polymarket allow users to trade on real-world events, including sports outcomes. However, unlike traditional sports betting, these markets are regulated by the U.S. Commodity Futures Trading Commission (CFTC).

The Attorney General argues that states have a right to regulate prediction markets as they would any other form of gambling, citing opposition from dozens of states across the ideological spectrum.

Kalshi has countered that it is not offering sports betting, but rather a future market where users can trade on events based on their perceived likelihood. This distinction has been disputed by experts, with Syracuse University's John Wolohan noting that prediction markets operate similarly to futures trading in commodities like oil or wheat.

The Supreme Court will now consider whether to take up the case and issue a ruling, which could have significant implications for the industry if it decides to side with New Jersey. Johns Hopkins Professor of Law Stacey Lee described the situation as 'a dispute over who gets to make the rules'.
