Athena Bitcoin agreed to settle a $4.5 million lawsuit over telemarketing texts, but claimants may receive less than $3 million.

The proposed settlement covers U.S. and Florida recipients who alleged Athena sent promotional messages after they had requested 'STOP.'

According to court records, class counsel plans to seek 33% of the fund, or $1.48 million, in fees, plus costs and expenses not expected to exceed $30,000.

If approved, this would leave nearly $3 million remaining for claimants before any representative award and notification costs are deducted.
