Behnam Sounds Alarm on Regulatory Uncertainty in Crypto
Former Commodity Futures Trading Commission Chairman Russ Behnam has sounded an alarm for more durable regulations in the crypto space. Speaking at Georgetown University's Psaros Financial Markets Quality Conference, he emphasized the need for a robust regulatory framework to address the growing uncertainty surrounding crypto.
Behnam criticized the existing patchwork authority under which the CFTC polices the spot market, likening it to 'a little bit of like Scotch tape and paper clips.' He warned that decisions made under this framework may be legally challenged, raising the risk for regulatory instability in the sector.
The Digital Asset Market Clarity Act failed to advance in the Senate on September 15, falling short of the necessary 60 votes with a 49-50 tally. The bill aimed to clarify the distinction between digital commodities and securities and expand the CFTC's authority over crypto derivatives and spot trading.
Behnam also highlighted concerns about the prediction market sector, stating that the line between risk management and gambling has become increasingly blurred as the industry grows in scale. He emphasized the need for Congressional involvement to determine where this line should be drawn.
