Bitcoin Survives Senate Rejection of CLARITY Act
The Senate's rejection of the CLARITY Act was not just another episode of party politics. The bill's failure was due to a more fundamental dispute over ethics, enforcement, and public trust.
Every Democrat who voted opposed the bill, joined by Republican Senators Susan Collins, Josh Hawley, Jerry Moran, and Thom Tillis. Tillis voted no to preserve an opportunity for reconsideration. This outcome was bipartisan, but it wasn't a repudiation of digital assets.
The CLARITY Act aimed to create a framework for classifying, issuing, trading, and supervising digital assets. However, its failure may be seen as a gift to Bitcoin operators and investors. It ended the political sideshow and prevented Washington from imposing a regulatory structure that might have created more confusion than clarity.
The decisive obstacle was ethics. President Trump championed the legislation despite having substantial financial interests in cryptocurrency ventures. Democrats argued that stronger restrictions were needed to prevent presidents or federal officials from shaping policies benefiting their own holdings.
