California Bans Meme Coins for Public Officials
California has taken a significant step in regulating cryptocurrency by barring public officials from issuing meme coins. Governor Gavin Newsom signed Assembly Bill 2409, which prohibits government employees from issuing meme coins and restricts digital asset platforms from listing certain tokens associated with public officials. The law defines a meme coin as a digital asset marketed based on its association with internet memes, characters, current events, or trends, and whose value is primarily derived from public interest, speculation, or community engagement.
The legislation targets the intersection of public office and speculative digital assets, placing compliance obligations on exchanges and other platforms serving Californians. Digital asset service providers will be prohibited from listing certain newly issued meme coins beginning January 1, 2027, when they are offered by, or in partnership with, a federal, state, or local public official.
The law gives the California attorney general, district attorneys, city attorneys, and county counsels authority to bring civil enforcement actions, including seeking injunctions and disgorgement. The measure comes amid heightened scrutiny of elected officials' financial interests in cryptocurrency, particularly President Donald Trump's involvement with digital assets.
