California Buries Meme Coin Ambitions for Public Officials
California Governor Gavin Newsom has signed into law restrictions on public officers issuing crypto meme coins. The new legislation, AB 2409, bans California public officers and certain government employees from creating these digital assets.
The bill sets two main restrictions: one for direct issuance by public officials and another for listing new official-linked coins on platforms serving California residents.
Under the law, 'issue' is defined as making a meme coin available for public purchase, donation, or exchange of any value. A meme coin is a digital asset tied to internet memes, public figures, fictional characters, current events, or social trends, with value derived primarily from public interest, speculation, or community engagement.
The law applies to both California state and local officers, as well as government employees with decision-making authority over procurement offers and contracts. Federal officials are also included in the provider listing clause, which prohibits listing for sale on behalf of, or for purchase by, a California resident a qualifying meme coin issued after January 1, 2027.
