CFTC Proposes New Rules for Leveraged Crypto Retail Trades
The Commodity Futures Trading Commission (CFTC) has introduced an Advanced Notice of Proposed Rulemaking aimed at creating a regulatory framework for leveraged digital asset transactions targeting retail investors. The proposal leverages the CFTC’s existing authority under the Commodity Exchange Act to integrate crypto trading into its national market structure. A 60-day public comment period has been opened to gather input before finalizing formal rules.
The framework proposes a dedicated registration subcategory called a "crypto asset market" for platforms offering leveraged, financed, or margin trades. The goal is to set industry standards and expand regulatory oversight to prevent fraud before it occurs, rather than relying on post-event enforcement.
CFTC Chairman Michael Selig emphasized the need for clarity and consumer protections in the crypto market, stating that the agency is committed to incorporating crypto transactions into its regulatory framework. The move comes amid legislative stagnation in Congress, where the Clarity Act, a bill to grant the CFTC statutory oversight over digital assets classified as commodities, has stalled. As a result, regulators are leveraging existing legal frameworks to advance the regulatory process.
The proposed rules could impact major digital asset platforms like Coinbase Global Inc, Crypto.com, and Robinhood Markets Inc, which currently offer leveraged trading products. Under the CFTC’s proposal, these venues can register under standard designated contract market rules, allowing flexibility for emerging derivatives and event-driven instruments while establishing specialized channels for leveraged spot retail products.
