CFTC Proposes New Rules for Leveraged Crypto Trading in the U.S.

The CFTC has proposed a new framework to allow leveraged crypto trading for the American public after the CLARITY Act stalled in Congress. The proposal, introduced on Monday, aims to clarify how registered CFTC entities can offer leveraged, margined, or financed crypto transactions. Under Section 2(c)(2)(D) of the Commodity Exchange Act, such trading is treated as if it were a futures contract, restricting it to registered futures markets through licensed brokers.

Uncertainty has long surrounded how registrants could offer these 'Retail Commodity Transactions.' If adopted, the new rules would significantly alter how exchanges, brokers, and market participants trade crypto products in the U.S. The CFTC also seeks to expand its oversight over certain spot transactions, potentially reducing the need for exchanges to register with state financial services regulators.

The proposal includes key provisions of a digital asset market framework, potential registration and compliance requirements, and operational changes for market participants. The CFTC's move reflects its broader push to assert authority over spot markets, potentially displacing state regulators' oversight of crypto exchanges.
