CFTC Seeks Public Input on Crypto Asset Regulatory Framework
The Commodity Futures Trading Commission (CFTC) has taken a significant step toward establishing a regulatory framework for crypto asset transactions under the Commodity Exchange Act (CEA). The agency issued an Advanced Notice of Proposed Rulemaking (ANPRM) seeking public comment on rules governing retail commodity transactions involving crypto assets, referred to as CTXs. This move aims to provide clarity, prevent fraudulent activities, and foster a uniform national regime for crypto markets.
CFTC Chairman Michael S. Selig emphasized the importance of the ANPRM, calling it a critical step in ensuring the U.S. remains a leader in the crypto space. The proposed framework is designed to prevent abuses, such as those observed in the FTX collapse, by focusing on proactive measures rather than reactive prosecutions. The Commission will draw on its experience overseeing crypto markets since 2014 to codify best practices and establish a dedicated subcategory for crypto asset market registration.
The ANPRM solicits input on three key areas: preventing abusive practices, providing contextual information for market participants, and codifying a subcategory of designated contract market registration specifically for CTXs. The public has 60 days from the ANPRM’s publication in the Federal Register to submit comments, which will shape future agency actions and potential rulemaking.
The CFTC’s proactive approach signals its intent to build a robust national regulatory structure for crypto operators. Industry stakeholders now have the opportunity to influence the final requirements on market structure and compliance through their comments.
