CFTC seeks public input on crypto asset regulatory framework
The US Commodity Futures Trading Commission (CFTC) has taken a significant step toward creating a comprehensive regulatory framework for crypto asset transactions. On Monday, the CFTC published an Advanced Notice of Proposed Rulemaking (ANPRM), inviting public comments on rules for retail commodity transactions involving crypto assets. This initiative aims to establish “fit-for-purpose” regulations under Section 2(c)(2)(D) of the Commodity Exchange Act, potentially shaping future guidelines for the crypto market.
CFTC Chairman Michael S. Selig emphasized that the goal is to provide clarity, certainty, and consumer protections. “The American people deserve clarity, certainty, and consumer protections in the crypto asset markets,” Selig stated, highlighting the agency's commitment to integrating crypto transactions into a uniform national regulatory framework. The proposed rules seek to prevent abusive practices and establish a consistent regulatory regime for these transactions.
The CFTC is also exploring the creation of a new category of designated contract market registration called a “crypto asset market,” tailored specifically for retail crypto transactions. Selig stressed the importance of preventive measures, noting the agency's focus on stopping misconduct rather than relying solely on enforcement after violations occur. He specifically cited the need to address fraudulent schemes like the FTX collapse.
Market participants and stakeholders have 60 days from the notice's publication in the Federal Register to submit written comments. The feedback collected will help inform potential future rulemaking concerning Section 2(c)(2)(D) and crypto asset transactions.
