CFTC Sends Crypto Rulemaking to White House Review

The Commodity Futures Trading Commission (CFTC) has filed a pre-rule on 'Crypto Asset Transactions and Regulation Crypto Asset Markets' under RIN 3038-AF80, moving it into White House review. The filing was received on September 17 and is still pending.

This is not a final rule, but rather a procedural step that indicates the CFTC has moved beyond informal discussion and has a regulatory package far enough along to send into the White House review process.

The proposal could clarify treatment of derivatives and perpetual contracts and set requirements for exchanges, brokers, margin, and clearing. This could enable more regulated crypto derivatives activity and broader adoption in the US markets.
