Circle's MiCA Delay Exposes Flaw in European Stablecoin Regulation
Circle's recent update to its legal terms has revealed a critical flaw in the MiCA stablecoin regulation in Europe. The regulation, which was supposed to provide bank-like protections for stablecoin holders, has introduced a subtle tension between token holders and issuers.
The update, which was made on October 5, 2026, states that Circle can temporarily delay European USDC redemptions if reserve assets cannot be transferred across borders during a failed rebalancing under MiCA stablecoin rules.
This means that a sudden surge of European redemption requests could outstrip the onshore reserve buffer, forcing a multi-day wait as assets move abroad. This could disrupt supplier payments, payroll, and other critical business operations that rely on USDC for crypto cross-border payments and treasury.
